简介:新形势下,建立以侦查需求为导向的打击犯罪合成作战机制,对提高预防、打击和控制刑事犯罪的整体效能,积极应对新形势下刑事犯罪的新变化、新规律、新特点,最大程度地盘活警力、信息、技术、手段资源具有重要意义。S省各级公安机关按照"信息资源整合、重大案件攻坚、系列案件支撑、集群战役组织、安全风险预警、整体移诉协调"的工作目标要求,因地制宜积极探索,对于建设合成化作战机制具有重要借鉴和推广价值。但应当看到,目前该机制的建立运行仍处于探索阶段,在运行机制、保障措施等方面不可避免地会出现一些问题,需要通过建立科学的运行机制和资源整合机制、加强专业队伍建设、完善配套保障机制等措施加以完善。
简介:通过统计发现,法释〔2016〕9号实施以来,受贿犯罪人呈现出性别比例失衡,年龄分布集中,高智商化等特性。在不法方面,工程项目等经济性较强的节点成为催生受贿的主要来源,犯罪数额以较大、巨大为主,但受贿行为本身的成本巨大。结构化理论中的规则与资源能够对受贿行为产生一定的解释力,而行为主体经济活动范围的有效界定、组织行为过程的公开化、自由裁量权的控制、刑量配置的公正性以及转变治理观念治理受贿犯罪的有效策略。
