简介：《刑法修正案（八）》在食品药品安全犯罪规定上增加了兜底条款，修改了部分犯罪的构成要件，加大了惩罚力度，增加了食品监管滥用渎职罪等，但实务中问题仍层出不穷。通过对S省H市法院系统承办的所有涉及食品药品安全犯罪的调研分析，发现其多发原因在于巨大经济利益的驱动、该类犯罪多为共同犯罪且行为人反侦查能力强、违法成本低且食品、药品监管部门职责不明。对此，应将危害食品、药品安全犯罪归属于危害公共安全罪，将生产、销售不符合安全标准的食品罪定性为行为犯，增加过失犯、扩大禁止令适用范围，如此才能更好地打击犯罪，维护社会经济秩序的正常运作。
